Terms of Service

These Terms of Service (“Terms”) govern your use of monitron.co.uk, including the fitness/productivity/finance platform, the Monitron Academy course (sold in full or as individual modules), and the Monitron TradingView indicator (together, the “Service”), operated by Justin Sutherland (“Monitron”, “we”). By creating an account or purchasing any product, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to purchase the Academy course, an Academy module, or the indicator. By using the Service you confirm you meet this requirement.

2. The Service is educational, not advice

The Academy course, the indicator, and any AI-generated trade analysis are provided for general educational purposes only and do not constitute personalised financial or investment advice. See our Risk Disclaimer for full detail — it forms part of these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorised access.

4. Payments and access

Payments are processed by Stripe. Prices are shown at checkout in the currency displayed. The Academy course (and each individually bought module) is a one-time purchase granting ongoing access unless stated otherwise at checkout. The indicator is sold as time-limited passes: access lasts for the pass period shown at checkout, a pass does not renew automatically, and a new pass bought while one is active starts when the current one ends. Indicator access is delivered through TradingView’s invite-only scripts and remains subject to TradingView’s platform rules; if changes by TradingView force us to end access before a pass expires, we will refund the unused part of that pass pro rata. Lifetime indicator access bought before 30 September 2026 remains lifetime. Subscription tiers (Pro/Max) renew automatically until cancelled. You can manage or cancel a subscription from your account settings at any time; cancellation takes effect at the end of the current billing period.

5. License to Academy and indicator content

On purchase, we grant you a personal, non-exclusive, non-transferable licence to access the Academy course content and/or the TradingView indicator for your own use. You may not share your login, your TradingView invite-only access, resell, redistribute, or publicly republish the course content or indicator, in whole or in part.

6. Intellectual property

The Service, including the Monitron platform and dashboards, the TradingView indicator’s logic and code, the Academy course materials (videos, text, quizzes, and supporting documents), and the Monitron name, logo, and branding, is owned by or licensed to Monitron and protected by copyright, database rights, and other intellectual property laws. The licence granted in §5 lets you use this content — it does not transfer any ownership of it to you. You retain all rights to the trade logs, notes, screenshots, and other data you input into the Service (“Your Content”); you grant us a limited licence to use Your Content solely to provide and improve the Service, including generating the AI analysis you’ve requested.

8. Acceptable use

You agree not to misuse the Service — including attempting to circumvent access controls, scraping or reverse-engineering the indicator, or using the Service for any unlawful purpose.

9. Service availability

We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free access. The Service may be unavailable due to scheduled maintenance, third-party outages (for example TradingView, Stripe, or our hosting providers), or factors outside our reasonable control. We may modify, suspend, or discontinue any part of the Service — including individual features, KPIs, or integrations — at any time; where reasonably practicable, we’ll give advance notice of material changes affecting paid features.

10. Disclaimers and limitation of liability

The Service is provided “as is”. To the maximum extent permitted by law, Monitron is not liable for any trading losses, indirect, or consequential losses arising from your use of the Service, the indicator’s signals, the course content, or any AI-generated analysis. Nothing in these Terms excludes liability that cannot be excluded under UK law (for example, liability for death or personal injury caused by negligence, or fraud).

11. Your statutory rights as a consumer

If you are a consumer contracting with us from the UK, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection law — including your right to digital content that is of satisfactory quality, fit for purpose, and as described. These Terms do not exclude or limit those rights, and where anything in these Terms conflicts with your statutory rights, your statutory rights take precedence.

12. Termination

We may suspend or terminate your account for breach of these Terms. You may close your account at any time via your profile settings or by contacting us.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified via email or an in-app notice before taking effect.

14. Governing law

These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
